• Personal Property Not Included.  Only title to the real estate is being conveyed. Personal property may be present, but is not included in the auction. Removal of personal property remaining on site at the time of closing is the responsibility of the Buyer.

• Zone, Code, and Use Disclosure.  Buyer acknowledges that the Property shall be purchased “AS-IS, WHEREIS, WITH ALL FAULTS.” The Property may be subject to city, village, and/or county code or zoning violations, and Buyer accepts the property subject to any such violations.  Buyer agrees to conduct an independent search of all property records in the city, county, and/or village prior to bidding and has bid accordingly.  Buyer shall be responsible for any and all required remediation of the property, if any.  Buyer shall not rely on any information provided by the Seller or Williams & Williams regarding the status of any code or zoning violations, and shall base its decisions on its independent inspection.  Buyer also acknowledges that the property may be subject to city, village, and/or county occupancy regulations and requirements which may impact the current and/or future use of the properties.  Buyer acknowledges that the seller and Williams & Williams make no warranties of any nature, express or implied, as to the permitted uses of the property, and any prohibition of buyer’s intended use of the property shall not be a grounds for terminating the contract.

Legal Description

ALL THAT TRACT OR PARCEL OF LAND, situate in the Town of Vestal, County of Broome and State of New York, more particularly bounded and described as follows: Commencing at a point on the east side of the highway commonly known as Route 26, which point is also the northwest corner of lands of James R. Plymate, as described in a deed dated December 1, 1954 and recorded in the Broome County Clerk’s Office in Book 881 of Deeds at page 514 on December 3, 1954. Thence N 66°27’ E along the north line of the said lands of James R. Plymale a distance of 600 feet to a point.
Thence N 28°45" W a distance of 200 feet to a point., Thence S 66°27’ W a distance of 600 feet to a point in the east line of said Route 26. Thence S 28°45’ E along the east line of said Route 26 a distance of 200 feet to the point or place of  beginning. The above premises are accepted and conveyed subject to a certain Easement and Right- of-Way for the purposes of maintaining the bank area contained in a deed from James R. Plymale and M.E. Doris Plymale to Robert J. Kuchera and Margaret J. Semanek which was recorded in the Broome County Clerk’s Office on January 12, 1988 in Book 1688 of Deeds at page 162.

*Abstractor’s Note - The description of the above parcel, situate at 2029 NYS Route 26 South, Tax Map No. 190.03-1-45, differs from the description of the said parcel as shown on the said tax map. The Tax Map shows that a 141.67 foot sliver of land at the northeasterly corner of parcel, Tax Map No. 
190.03-1-45, was given to Lot 17 of Section 3 Sunset Manor Subdivision, conveyed out by Steve & Catherine Barsosky to Douglas V. Ellis by deed dated July 19, 1962 and recorded July 24, 1962 in Book 1055 of Deeds at page 785.

Said beginning point is described as follows: Commencing at the northwest corer of lands of James R. Thence N 28°45" W a distance of 143.76 feet along the east line of said Route 26 a distance of 143.76 feet to a point; thence N 15°15’ W along the east line of said Route 26 a distance of 64.50 feet to a point; thence N 72°30" E a distance of 593.89 feet to a point; thence S 28°45" E a distance of 145 feet to a point; thence S 66°27 W a distance of 600 feet to the point or place of beginning. SUBJECT TO ANY AND ALL RESTRICTIONS, EXCEPTIONS, RESERVATIONS, STIPULATIONS, CONDITIONS, RIGHTS OF WAY AND EASEMENTS OF RECORD. Being the same property as conveyed from William T.
