Property Disclosures
- Property is being sold in an "as is" condition, and the condition is unknown and may include defects, possible health or safety hazards, or debris, or be located in a Special Flood Hazard Area.
- Proof of Funds Required. The seller requires that the high bidder be able to demonstrate proof of funds or financing pre-qualification within 24 hours of the auction. Buyer must obtain a "pre-qualification" letter from a lender of their choice. If buyer intends to pay with cash, a bank letter or other financial account statement showing proof of sufficient funds to cover 100% of the purchase price will be required (account numbers should be removed or redacted). Buyer understands and agrees to submit said documentation to auctioneer within 24 hours of the auction.
- By placing a bid or offer on a property, Buyer is accepting the property in "as-is where-is condition" and agrees to be bound to the bid or offer should a discrepancy arise.
- Auction is for 2nd mortgage lien position. To obtain clear title, Buyer will be responsible to pay off senior liens, including a 1st mortgage lien of approximately $284,690.81 through 1/20/2025 (per diem of $24.86 thereafter). Prospective buyers are encouraged to investigate the existence, priority and size of outstanding liens that may exist by contacting county recorder’s office or a title insurance company. Seller will not warrant against any defects that existed in the property before property was deeded to Seller.
- Quit Claim Deed Disclosure. Buyer is purchasing the Property "as-is, where-is," with all faults and encumbrances, and without warranty or representation of any kind or manner, including, without limitation, clear or marketable title. The Property shall be conveyed by the Seller via quit claim deed, and Buyer shall accept the property subject to all liens, encumbrances, assessments, encroachments, easements, or other liabilities of any manner, known and unknown. Buyer accepts all responsibility for any remediation, fees, or terms required by any authority, which may or may not include demolition, escrow fees, or habitation certificates.
- Personal Property Not Included. Only title to the real estate is being conveyed. Personal property may be present, but is not included in the auction. Removal of personal property remaining on site at the time of closing is the responsibility of the Buyer.
- Escrow. Buyer acknowledges receipt of the Joint Escrow Instructions – Addendum A that modifies the Contract for Sale to provide for a designated Escrow Agent to hold down payment funds. Buyer and Seller agree that the Escrow funds may be held in a trust/escrow account located outside of the state where the Property is located.
- Seller Mandated Financing Disclosure: The seller requires that the high bidder be able to demonstrate proof of funds or financing pre-qualification within 24 hours of the auction. This notice is being provided simply to inform you that information about the general location of gas and hazardous liquid transmission pipelines is available to the public via the National Pipeline Mapping System (NPMS) Internet Web site maintained by the United States Department of Transportation at http://www.npms.phmsa.dot.gov/. To seek further information about possible transmission pipelines near the property, you may contact your local gas utility or other pipeline operators in the area. Contact information for pipeline operators is searchable by ZIP Code and county on the NPMS Internet Web site.
- Buyer understands and acknowledges that square footage, acreage, and/or bedroom and bathroom count for the building sited on the property is based on an appraisal or county assessor information. Buyer further understands and acknowledges that measurements/acreage/count can vary from a few feet to several hundred feet regardless of source (County Assessor’s records, appraisal, or appraisal measurement report, etc.) and that said sources may contain erroneous information or measurements/acreage/count. Buyer should conduct their own investigation and satisfy that the size and/or square footage, acreage, and bedroom/bathroom count of the dwelling/building is acceptable to the Buyer prior to placing any bid or offer on a property.
- By placing a bid or offer on a property, Buyer is accepting the property in “as-is where-is condition” and agrees to be bound to the bid or offer should a discrepancy arise.
- Occupation and Utilities Disclosure. To the best of Seller’s knowledge, the property is occupied. The Buyer accepts responsibility for any necessary eviction, lease/rental negotiations, or other remediation to clarify the legal occupancy status. The Buyer further agrees to hold the Seller, Williams & Williams, and its agents harmless from any and all consequences and costs, including attorney’s fees, arising from the occupancy status.
The Buyer also acknowledges and understands that the utilities for the property have not been disconnected. The Buyer accepts responsibility for payment of all utilities consumed and used by the tenants. The Buyer shall be solely responsible for any collection or reimbursement of utility payments from the tenants.
