* Buyer is responsible for all escrow and closing fees typically ranging from $750-$3000. It is the Buyer's responsibility to contact a local title agency or real estate attorney for a property specific estimate prior to placing a bid.

Second Chance means it did not sell to a new homeowner at the Foreclosure Auction. During this Second Chance auction period, Seller advises the home is discounted below Seller's appraised value. This is a limited time opportunity.

Open Public Inspections: Property is occupied and will not be available for inspection. Please do not disturb occupants.

Property Disclosures

* Property is being sold in an as-is condition, and the condition is unknown and may include defects, possible health or safety hazards, or debris, or be located in a Special Flood Hazard Area.

* Proof of Funds Required. The seller requires that the high bidder be able to demonstrate proof of funds or financing pre-qualification within 24 hours of the auction. Buyer must obtain a pre-qualification letter from a lender of their choice. If buyer intends to pay with cash, a bank letter or other financial account statement showing proof of sufficient funds to cover 100% of the purchase price will be required (account numbers should be removed or redacted). Buyer understands and agrees to submit said documentation to auctioneer within 24 hours of the auction.

* Utilities Disclosure. The utilities to this property are not currently turned on and the property has been winterized. Utilities will not be turned prior to closing, regardless of inspections. Buyer will need to consider this and account for it if/when inspecting the property. Buyer is responsible for utility transfer post-closing.

* Square Footage/Acreage Disclosure. The source of the square footage or acreage represented for the property is from public record. Buyer understands and acknowledges that square footage or acreage measurements of a property can vary from a few feet to several hundred feet regardless of source (County Assessor�s records, appraisal or appraisal measurement report, survey, etc.). Buyer shall be solely responsible for satisfying that the size and/or square footage or acreage of the property is acceptable to the Buyer. Certificate of Occupancy May Be Required. The Property is subject to a City of Detroit's Certificate of Occupancy inspection. Buyer acknowledges that as of November 17, 2014 the inspection will no longer be required due to the Detroit City Council recent repeal. While the repeal is pending the requirement to obtain the inspection has been suspended. Buyer acknowledges that should this requirement be reenacted that said inspection will be ordered and Buyer would need to retrieve a copy of the Pre-sale Notice of Deficiencies Report for the Property from the City of Detroit at Buyer's expense. Buyer is purchasing the Property as-is, where-is, and agrees to sign and return the Affidavit of Compliance Responsibility (ACR) prior closing if it is required. Buyer agrees to complete all necessary repairs, and accepts responsibility for all compliance measures required by any required inspection prior to occupancy. Should proceedings for demolition be filed, Buyer agrees to provide the city with copies of the ACR/City inspection, the Contract for Sale signed by the Seller, the Lis Pendens in relation to the violations, photographs, fees, and any other documents required. Buyer agrees to assume all liability for all required compliance measures, and shall hold Seller harmless for any and all effects thereof. Buyer understands and acknowledges that the Property may present a bio-environmental hazard, and Buyer is solely responsible for cleaning, removing, or demolishing per the City of Detroit's advisory conclusions found with the ACR. Buyer agrees to complete all necessary repairs, and accepts responsibility for all compliance measures required before occupancy, which may include demolition. Septic/Well Inspection Disclosure. The Property may be subject to a Wayne County well/septic inspection. Buyer agrees to comply with all requirements necessary to complete the inspection and closing, including, but not limited to, obtaining the inspection report, permits and making arrangements to correct any noted Wayne County environmental health violations at Buyers sole expense. Point of sale well/septic inspection must be ordered between thirty (30) and forty-five (45) days of occupancy. Buyer accepts all responsibility for any remediation, fees, or terms required by the authority thereof. Buyer should conduct an investigation into cost of compliance with septic requirements prior to bidding.
